This Privacy Policy describes how Happy Trading LLC (d/b/a Hajde Zemer) ("Company," "we," "us") collects, uses, and protects information from participants in our Ambassador Program ("Program").

This policy supplements our general Privacy Policy and applies specifically to data collected through the Ambassador Program.

1. Information We Collect

1.1 Information You Provide

When you apply to or participate in the Program, we collect:

  • Identity Information: Full name, email address, phone number, date of birth (for age verification)
  • Social Media Information: Instagram handle, TikTok handle, YouTube channel, follower counts, and content samples
  • Shipping Information: Mailing address (for gifted products)
  • Payment Information: PayPal email or bank details (for commission payouts), processed through our third-party affiliate platform
  • Application Information: Country of residence, content types, reasons for applying, preferred referral code
  • Communications: Messages you send to us through Telegram, email, or other channels

1.2 Information Collected Automatically

  • Referral Tracking: Sales, clicks, and conversions attributed to your unique code or link
  • Performance Data: Commission earnings, payout history, content engagement metrics
  • Device Information: IP address, browser type, and device information when accessing the ambassador portal

1.3 Information from Third Parties

  • Affiliate Platform (GoAffPro): Sales data, referral tracking, commission calculations
  • Social Media Platforms: Publicly available profile information, follower counts, engagement rates
  • E-commerce Platform (Shopify): Order information related to your referral activity

2. How We Use Your Information

We use collected information to:

  • Administer the Program: Process applications, manage your ambassador account, track referrals, and calculate commissions
  • Communicate with You: Send program updates, product information, campaign briefs, and payout notifications via email and — if you opt in on the application form — SMS/text and Instagram direct message
  • Process Payments: Calculate and distribute commission payouts
  • Ship Products: Send gifted items to your shipping address
  • Marketing: Use your content and likeness as described in the Program Terms & Conditions (Section 4)
  • Improve the Program: Analyze program performance and ambassador engagement
  • Prevent Fraud: Detect and prevent fraudulent referral activity, self-referrals, or Terms violations
  • Legal Compliance: Comply with tax reporting requirements and applicable laws

2.1 Marketing Communications

We will only send you marketing SMS/text messages or Instagram direct messages if you specifically opt in to those channels on the application form. SMS and DM consent are voluntary and are not a condition of program participation.

SMS opt-out: Reply STOP to any text message, or email info@hajde-zemer.com. Reply HELP for help. Message frequency varies. Message & data rates may apply. Carriers are not liable for delayed or undelivered messages.

Email marketing: By accepting this Privacy Policy you agree to receive program-related email from Hajde Zemer. You can unsubscribe from marketing emails at any time using the link in any email or by emailing info@hajde-zemer.com. Transactional messages (payout notifications, account updates) will continue.

Instagram DM opt-out: Reply to any DM asking us to stop, unfollow, or block our account.

3. How We Share Your Information

We may share your information with:

  • Service Providers: Third-party platforms that help us administer the Program, including:
    • GoAffPro (affiliate tracking and payouts)
    • Shopify (e-commerce and order management)
    • Klaviyo (email marketing)
    • Our fulfillment partners (for product shipping)
  • Payment Processors: To facilitate commission payouts
  • Legal Authorities: When required by law, subpoena, or legal process
  • Business Transfers: In connection with a merger, acquisition, or sale of assets

We do not sell your personal information to third parties.

4. Data Retention

  • Active Ambassadors: We retain your information for the duration of your participation in the Program.
  • Former Ambassadors: We retain your information for up to 3 years after termination for tax, legal, and audit purposes.
  • Content License: Per the Terms & Conditions, the content license granted to us is perpetual and survives termination. We may retain Ambassador Content indefinitely.
  • Application Data: Rejected applications are retained for 12 months to prevent duplicate applications.

5. Your Rights

Depending on your location, you may have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate or incomplete information
  • Delete your personal information (subject to legal retention requirements)
  • Opt out of marketing communications
  • Withdraw consent (where processing is based on consent)

Note: Deleting your information may affect your ability to participate in the Program. The content license granted in the Terms & Conditions is not affected by deletion of personal data.

6. International Data Transfers

Your information may be transferred to and processed in the United States and other countries where our service providers operate. By participating in the Program, you consent to these transfers.

7. Security

We implement reasonable administrative, technical, and physical safeguards to protect your information. However, no method of transmission over the internet or electronic storage is 100% secure.

8. Children's Privacy

The Program is not intended for individuals under 18 years of age. We do not knowingly collect information from minors.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify active ambassadors of material changes via email. Continued participation after notification constitutes acceptance.
